That by ordering any services of LINDEN AND CO LLC, its affiliates, employees, agents and owners (hereinafter all referred to as “LCO”) the customer agrees to and acknowledges the following:
All inspections, approvals and reports are provided for the customer of LCO only and are not to be relied upon nor used by any other parties. Same are for information purposes only and are not any form of representation, guarantee or authentication of any kind.
No statements or representation of any kind made by the seller, broker, agent or others may be imputed to LCO, and any disputes, actions or proceedings concerning any vehicle shall not include LCO. Any such legal proceedings involving LCO are to be governed by the laws of the State of Tennessee and only maintained in State of Tennessee courts.
The buyer / customer must exercise his / her own due diligence and not rely on any inspection, appraisal or report of LCO or its affiliates, employees, agents and owners in deciding whether or not to buy any particular vehicle and hold harmless and defend same for all damages, awards and attorneys’ fees for any claims, actions or proceedings involving the subject vehicle in which they may be joined as a party.
The purpose of this inspection or appraisal is to report the condition and value of the vehicle. It is explicitly stated that the purpose of same is not intended to be an “authentication” of this vehicle, nor is it intended to establish the originality of the vehicle or any of its components. Any references relating to authenticity or originality that are included in any report or appraisal are either made by the owner of the vehicle, or are a matter of opinion, and are subject to verification.
The inspection or report has been produced by, and is the property of, LINDEN AND CO LLC. It may be used without restrictions by the person(s), or entity named at the top of the report. This inspection or report is current as of the date of inspection specified.
All vehicle inspections or appraisals are visual only and do not involve any testing nor any disassembly nor reference to any third-party statements or opinions. Thus, it is understood and agreed that LCO is not responsible for not discussing or reporting any hidden or concealed rust, defects or aspects of any vehicle that could not be seen by the inspector at the time of inspection. Also, knowing that all vehicles, especially classic or antique vehicles, are complex goods with many components or parts that can fail or break at any time, LCO is not liable for any product defects or failures at any time, and any such claims must be directed to the seller / owner / broker and exclude any claims of any kind against LCO.
This is no replacement for nor constitutes state DMV inspections, emissions testing and any other testing, which are beyond the scope of this service. This is not any opinion as to the legal status of the vehicle, its owner / seller nor its title, which legal matters and opinions are beyond the scope of this service.
LCO does not assume any responsibility for any descriptions, statements, warranties, ads, photos, opinions or the like made by any third-parties, the owners, brokers or agents. The customer is responsible for all purchase discussions and any reliance on this report, inspection or appraisal is without any warranties expressed or implied.
The liability, if any, of LCO is limited to the cost paid by the customer for this service. No report shall be issued until paid in full. The customer acknowledges receipt of these terms and disclaimers and represents being over the age of 18 years.
Regardless of the condition of the vehicle, its value and working and non-working features and components, LCO assumes no responsibility for the vehicle at any time and the customer waives and discharges any liability of LCO for any oral or written statements by any party concerning the vehicle at all times and agrees not to commence any action or proceeding for any claims of any kind, including, but not limited to, errors, omissions and negligence against LCO, its agents and employees at any time, but for any legitimate claims of willful misconduct.
